JAMBI, bhayaksa.net—-The dynamics of criminal law in the jurisdiction of Jambi Province were heavily shaken by intense controversy following the verdict of the pretrial lawsuit under case registration number 18/Pid.Pra/2026/PN Jmb. In the final verdict reading session held at the Tirta Courtroom today, October 19, 2026, Sole Judge Tatap Urasima Situngkir, S.H., unexpectedly ruled to dismiss the petition filed by four former police personnel as the petitioners, namely Dudi Handika Rahman, Eleon Besta Dewo, Muhammad Ali, and Eko Friandiko. The judge’s gavel blow immediately triggered public speculation suspecting case manipulation and indications that this tragic death case had been compromised to secure the interests of certain rogue investigators.

Series of Procedural Anomalies and Chronology of Legal Flaws in the Investigation Administration

The actions of the Jambi Regional Police Criminal Investigation Directorate (Ditreskrimum Polda Jambi) in establishing the legal status of the petitioners are strongly alleged to have violated criminal procedure regulations and legitimate police Standard Operating Procedures (SOP). Based on the courtroom facts exposed directly by the petitioners’ defense counsel, Chris Januardi, S.H., M.H., there are three indications of acute maladministration and formal file manipulation that occurred from the very beginning of the investigation:

  • Corpse Identity Swapped and Mistaken Object (Error in Persona): Chris Januardi, S.H., M.H. presented undeniable evidence before the court that the official request letter for autopsy and visum from investigators allegedly suffered a fatal error. The fundamental document determining the cause of death completely failed to include the name of the deceased victim, Brigadier EWS, and was instead written under the name of Eko Friandiko—which is actually the name of his client or a suspect who is still alive and currently in detention. The initial documents were also revealed to have been unnaturally altered from the name Eko Priyanipho to Eko Winanusa Putra.
  • Disregard for Forensic Regulations and Police Protocols: The official examination report files submitted by the Respondent were proven not to attach the official physical identification tag to the body of the deceased. This clear negligence explicitly violates the mandate of Article 133 paragraph (3) of the Criminal Procedure Code (KUHAP) and National Police Chief Regulation (Perkapolri) No. 6 of 2019 concerning Criminal Investigation Management.
  • Legally Flawed Witness Summoning Procedure: The investigators allegedly conducted the summoning and examination of witnesses and the petitioners unlawfully, specifically by using long-distance telephone calls without ever issuing an official Service Summoning Letter, an omission that breaches the regulatory boundaries of Article 112 paragraph (1) of the Criminal Procedure Code (KUHAP).

The Paradox of the Judge’s Verdict: Why Was the Petition Dismissed When Allegations Were Insubstantive?

Doctrinally, the fatal error in naming the corpse should have automatically rendered all criminal articles charged against the petitioners void by law due to the loss of certainty regarding the object of the case. Nevertheless, Sole Judge Tatap Urasima Situngkir remained steadfast in dismissing the petitioners’ files by hiding behind the jurisdictional shield of Article 77 of the Criminal Procedure Code (KUHAP) and the Constitutional Court Decision No. 21/PUU-XII/2014. The judge claimed that pretrial institutions only hold the authority to examine the quantitative aspect of formalities (the existence of two pieces of evidence), while the chaotic naming of the corpse was dismissed as a mere “technical-material oversight” whose examination is transferred to the main criminal court trial.

The judge’s unilateral decision to validate the procedures of the Jambi Regional Police Criminal Investigation Directorate is viewed by the public as a step to save the face of the law enforcement agency so that their internal material sloppiness does not gain public exposure. Based on this material injustice, the defense team emphasized that they will not remain silent and are ready to bring all evidence of this alleged file manipulation to the central level by reporting the sole judge to the Judicial Commission (KY) for alleged violations of the judicial code of conduct, as well as reporting the rogue investigators to the National Police Headquarters (Mabes Polri) to restore fair legal certainty for the petitioners.
